11. FORCE MAJEURE

11.1 Exemption: EURL L'IDÉE MOTEUR is not responsible for delays or non-performance of its obligations when these result from a case of force majeure within the meaning of article 1218 of the Civil Code, notably: strikes, social conflicts, component shortages, customs blockages, natural disasters, epidemics, supplier or carrier failures, computer breakdowns, fire, energy cuts, wars, acts of terrorism, government decisions, or any other unforeseeable and irresistible event.

11.2 Termination: If the impediment persists beyond 60 days, each party may terminate the current sales contract by registered letter with acknowledgment of receipt, without compensation on either side.


12. MEDIATION AND DISPUTES

12.1 CONSUMER MEDIATION: In accordance with articles L. 611-1 et seq. of the Consumer Code, individual consumer customers may refer the matter free of charge to the Commerce Mediator in case of unresolved dispute:

The Mediator may be contacted two months after the first written complaint to the Seller and within a maximum period of one year. The Mediator will formulate a proposal within 3 months. Both parties remain free to follow or not follow the proposal.

12.2 European platform: The consumer customer is informed of the existence of the European online dispute resolution platform: https://ec.europa.eu/consumers/odr/

12.3 Legal jurisdiction:

  • For individual customers: The legal rules of jurisdiction of the Code of Civil Procedure apply. The competent court is that of the place where the defendant resides or, at the consumer's choice, that of the place of delivery or the place where the consumer resided at the time of conclusion of the contract.
  • For professional customers: Any dispute falls under the exclusive jurisdiction of the Commercial Court of La Roche-sur-Yon.

12.4 Applicable law: These T&Cs are governed by French law.

12.5 Proof: The customer accepts that electronic communications, telephone recordings (with prior consent) and the Seller's computer data constitute admissible evidence in case of dispute, in accordance with articles 1366 and 1367 of the Civil Code.
